Description |
The paper aims at analysing some elements of the model of damages concerning utilities stemming from productive goods. The topic is examined in the light of Italian Laws and literature. First of all is taken into account the jural conceptualisation of damages and the influence of the nature of the liablity. A specific attention is paid to both the causal nexus and the possibility of forecasting the consequences of the acts originating economic deadweight losses. The paper suggests that the evaluation model should be based upon the concept of economic organization. This framework seems to provide a more comprehensive conceptual support to the evaluation process. A simple procedure is provided, pointing out its compatibility with the usual approach in damages appraisal.
