Description This article focuses on emphasizing howa variety of apparently irrelevant legislationimperfections may induce significant misunderstandingsregarding the real spirit of democraticgovernance, corrupting the practice of activecitizenship in the policy-making processes anddepriving the Romanian public administration ofan important and valuable instrument for efficientgovernance and implementation of sustainabledecisions. The authors chose to analyze aspectsof the related legislation, as it represents afundamental element needed for the developmentof active citizenship. This article is the result of alarger on-going research on the phenomena ofpublic participation and policy dialogue that aimsto provide a more accurate understanding ofactive citizenship mechanisms and to investigatethe existence of a deliberative conscience at thelevel of the Romanian society.
