Description Recently the concept of supranational rules has an increasing importance especially in commercial law area. For this reason, general custom rules that will be in force for all the nations tried to be formed. After this formation, a real person or legal entity merchants, whoever violets these universal rules could be punished and be registered to the records kept for commercial ethics. This will give the opportunity to the judges and arbitrators to search the merchants if they have a moral conviction registered in the records kept for them when they come before the court. The judgment will be personal in commercial suits and in this way it will be possible to make the merchants to take pains in obeying the rules.
Son dönemlerde, özellikle ticaret hukuku alanında uluslarüstü kurallar kavramı giderek artan bir şekilde önem arz etmektedir. Bu sebeple tüm uluslar için geçerli olan genel (örf ve adet veya ahlak) kuralları oluşturulmaya çalışılmaktadır. Bu kurallar oluşturulduktan sonra bunlara aykırı davranan gerçek veya tüzel kişi tacirler bu konuyla ilgili bir sicile (ticari sabıka) kaydedilebilirler. Bu sayede hakimler / hakemler önlerine gelen davalarda uyuşmazlığın tarafı olan tacirlerin bu sicillerdeki kaydına göre, deyim yerindeyse ticaret ahlakı bakımından sabıkaları olup olmadığını görerek, ceza davalarındaki gibi ticari davalarda da kararlarını  kişiselleştirebilirler ve böylece tacirlerin bu kurallara uymaya azami özeni göstermeleri sağlanabilir.
